  • Emails (E-Newsletters, E-Notices) & SMSes
    • ProBooking is not responsible for the sending of emails and / or smses. Service Providers registered with ProBooking have access to an electronic communication module from which they can send smses and / or emails to users who have added them as one of their favourites.

    If you wish to no longer receive emails or smses from any Service Provider, you can remove them from your favourite list at any time. Once removed from your favourites, that specific Service Provider will no longer be able to send you smses and/or emails.

  • Data Privacy and Confidentiality
    • ProBooking shall receive and deal with all Data in the strictest confidence and shall not disseminate, pass on or make known any Data (or any part thereof) to any person other than the person for which it was intended, and may not use any Data for any other purpose than its use in the course of and for the purpose of providing the Services.

    Despite of ProBooking’s best efforts to keep all the client’s information secure, ProBooking does not accept any liability for the loss or leakage of any information and Probooking is held harmless against any claim, direct or indirect, for the loss or leakage of any information.

  • Limitation of Liability
    • The Services offered by ProBooking are based on “best effort”. ProBooking commits to offering a professional service and to do everything in their power to restore any Services offered as soon as possible, should it become unavailable for any reason, but cannot be held liable for anything based on the unavailability of any Services.

    ProBooking (both for itself and on behalf of its servants, contractors and agents) does not accept any liability for any act, omission, default or neglect of their servants, contractors and agents for any death, injury, damage, loss to persons or goods whatsoever and howsoever the same may be caused.

    ProBooking does not warrant and is in no way responsible for the accuracy of the information given or statements made by its servants, contractors and agents to individual or organisation or their servants or agents.

    ProBooking is hereby indemnified and held harmless against all and any loss or damage of any cause arising from or which it or any individual or organization may sustain as a result of the provision of or the lack of the provisioning of the Services.

    ProBooking will under no circumstances be liable for any indirect, incidental or special loss or damage, whether arising from negligence, breach of contract, or whatever reason.

  • No warranties
    • This system and/or website is provided “as is” without any representations or warranties, express or implied. ProBooking makes no representations or warranties in relation to this system and/or website or the information and materials provided.

    Without prejudice to the generality of the foregoing paragraph, ProBooking does not warrant that:
    • this system and/or website will be constantly available, or available at all; or
    • the information on the system and/or this website is complete, true, accurate or non-misleading.
